color: rgb(0, 0, 0);\">Ende Oktober 2024 hat das Bundeswirtschaftsministerium f\u00fcr Klimaschutz und Energie (BMWK) einen noch nicht ressortabgestimmten Gesetzentwurf ver\u00f6ffentlicht, der auf eine St\u00e4rkung der gesetzlichen Buchpreisbindung zielt.<o:p><\/o:p><\/p><p class=\"MsoNormal\" style=\"margin: 0cm; line-height: normal; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\">&nbsp;<o:p><\/o:p><\/p><p class=\"MsoNormal\" style=\"margin: 0cm; line-height: normal; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\">Grunds\u00e4tzlich besteht ein Verbot der Preisbindung der Zweiten Hand, das jedoch nicht f\u00fcr Verlagserzeugnisse gilt. Bis September 2002 wurde die Preisbindung f\u00fcr Verlagserzeugnisse durch das&nbsp;Gesetz gegen&nbsp;Wettbewerbsbeschr\u00e4nkungen&nbsp;(GWB) geregelt. Seit dem 01.10.2002 wird die Preisbindung f\u00fcr Verlagserzeugnisse durch das Gesetz \u00fcber die Preisbindung f\u00fcr B\u00fccher&nbsp;(BuchPrG) geregelt. Das BuchPrG verbietet zum \u201eSchutz des Kulturgutes Buch\u201c auf der Ebene des Bucheinzelhandels Preiswettbewerb: Verlage m\u00fcssen f\u00fcr den Verkauf von B\u00fcchern an Letztabnehmer einen Preis festlegen, den der Einzelhandel nicht \u00e4ndern darf.<o:p><\/o:p><\/p><p class=\"MsoNormal\" style=\"margin: 0cm; line-height: normal; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\"><o:p>&nbsp;<\/o:p><\/p><p class=\"MsoNormal\" style=\"margin: 0cm; line-height: normal; font-size: 11pt; font-family: Aptos, sans-serif; color: rgb(0, 0, 0);\">Der Gesetzentwurf regelt nun ein Rabattverbot f\u00fcr die Vermittlung eines Buchverkaufs an Letztabnehmer. Diese Konstellation war bislang nicht vom BuchPrG erfasst. Sie birgt nach Ansicht des BMWK \u201edie Gefahr der Aush\u00f6hlung der gesetzlichen Buchpreisbindung zulasten der Buchbranche und des Kulturgutes Buch\u201c. Hintergrund ist die Absicht eines strikteren Vorgehens gegen teilweise auch von der Rechtsprechung gest\u00fctzten Praktiken von digitalen Marktpl\u00e4tzen, wie Amazon oder ebay, Rabatte zu gew\u00e4hren (z. Ber\u00fchrt ist n\u00e4mlich auch der Anwendungsbereich des Art. 101 AEUV. Es ist allerdings fraglich, ob das Kabinett jetzt nach dem Bruch der Regierungskoalition sich noch mit dieser Materie befassen
